Inspire Clinic · Rockhampton, Queensland Terms and ConditionsThe terms on which Inspire Clinic provides physiotherapy and rehabilitation services and operates its website. Part A covers our practice, fees and appointment terms; Part B covers use of our website. These Terms and Conditions form an agreement between you and 1nspire Clinic Pty Ltd (ACN 687 250 399) as Trustee for the 1nspire Clinic Unit Trust (ABN 29 719 447 474), trading as Inspire Clinic, of Tobruk House, Shop 2, 8 Archer Street, Rockhampton City QLD 4700. By booking or attending an appointment, or by using our website, you acknowledge that you have read and agree to be bound by these Terms. They should be read together with our Privacy Policy. If you do not agree, please do not use our services or website.
Part A — Practice, fees and appointments 1. Agreement and definitionsIn these Terms, "Inspire Clinic", "we", "us" and "our" mean the legal entity described above; "you" and "your" mean the patient, or the parent, guardian or representative making a booking or accepting treatment on a patient's behalf; "services" means the physiotherapy, rehabilitation and related services we provide; and "website" means inspireclinic.au and any associated booking portals or pages we operate. 2. Our servicesInspire Clinic provides physiotherapy, cardiorespiratory rehabilitation and related assessment, exercise and education services. Our physiotherapists hold current registration with the Physiotherapy Board of Australia; that registration is administered by the Australian Health Practitioner Regulation Agency (Ahpra), and any practitioner's registration can be checked on the public register at ahpra.gov.au. We will exercise reasonable care and skill in providing our services and will keep you informed about your care. Outcomes of physiotherapy and rehabilitation vary between individuals, and we do not guarantee any particular clinical result. 3. Appointments and bookingsAppointments may be made by phone, in person, or online through our booking portal. Online bookings are subject to availability and are not confirmed until accepted by our reception team; a booking request alone does not guarantee an appointment. Please arrive a few minutes early and bring your referral, Medicare or relevant funding details, and a list of your current medications. If you are unwell or have symptoms of an infectious illness, please contact us to discuss your appointment before attending. 4. Fees and paymentFull payment for a consultation is required at the conclusion of each booked consultation. We accept payment by EFTPOS; EFTPOS surcharges/transaction fees may apply and form part of the amount payable. If you hold a valid Medicare card and an eligible referral (for example, under a GP Chronic Condition Management Plan (GPCCMP)), you may be entitled to a Medicare rebate for your consultation. A gap fee — the difference between our fee and the Medicare rebate — is payable on each consultation. The amount depends on whether the consultation is an initial or a subsequent one, and the gap does not exceed $275. Our current fee for each consultation type is published on our Fees page. If you ask before your appointment, reception will tell you the fee that applies to you and your likely out-of-pocket cost. At the consultation you pay the full amount (the Medicare rebate component + the gap fee + any EFTPOS fees). You will receive an invoice for the exact amount. Where you are eligible and we have your bank details registered with Medicare, your Medicare rebate is then paid directly into your nominated bank account, generally within 48 hours (longer where the consultation falls over a weekend or public holiday). You do not need to attend a Medicare office to receive the rebate. Please contact us if your rebate has not been received. Want a price first? We're happy to give you an indication of the fee and likely out-of-pocket cost for your consultation before you attend — just contact reception. 5. Medicare, DVA, NDIS, WorkCover and health-fund claimsWe can assist with claims and rebates under Medicare, the Department of Veterans' Affairs, the NDIS (self-managed and plan-managed plans only, as set out below), WorkCover Queensland, aged-care arrangements and private health funds where you are eligible and have provided the necessary documentation. NDIS: Inspire Clinic is not a registered NDIS provider. We can therefore provide services to self-managed and plan-managed participants only; we are unable to invoice agency-managed (NDIA-managed) plans. Physiotherapy is claimed as a therapeutic support under Improved Daily Living, and it is your responsibility (or your plan manager's) to confirm the plan holds sufficient funding for that support. Aged care: we provide physiotherapy under the Support at Home program — in your own home or at our clinic, whichever suits you. Support at Home replaced the Home Care Packages Program on 1 November 2025; where you transitioned from a Home Care Package, those transitional arrangements continue and we can bill against them. We do not attend residential aged-care facilities, and we do not provide services under the Commonwealth Home Support Programme (CHSP). You remain responsible for any amount not covered, approved or paid by a third-party funder, including where a claim is declined, an approval lapses, or funding is exhausted. For workers' compensation and third-party-funded care, you may be personally liable for fees if the claim is not accepted or ceases. Complaint routes for NDIS participants and aged-care clients are set out on our Concerns and complaints page. 6. Additional feesThe following additional fees may apply. Where paperwork or additional assessment is required, please tell our administration team in advance so we can plan your appointment duration accordingly. Routine correspondence is not charged. The written summary we send your referrer after an initial assessment, progress notes at review points and the discharge summary at the end of an episode are part of the service and attract no fee. The paperwork fee below applies to reports and documentation prepared for a separate purpose — an NDIS or aged-care funding application or plan review, an employer or insurer form, a medico-legal request, or an assessment carried out outside a booked consultation. We will tell you the fee before we begin.
7. Cancellations and non-attendanceWe understand that plans change, and life happens. Please give us at least 24 hours' notice to cancel an appointment. For NDIS-funded appointments the notice period is 2 clear business days, in line with the current NDIS cancellation rules. If you would like to move an appointment to another time rather than cancel it, we ask for at least 12 hours' notice — call reception on 0402 166 415. A single late cancellation or missed appointment is not charged. Where cancellations at short notice or missed appointments occur repeatedly, we may charge a fee of $125 plus EFTPOS fees. This fee is not claimable from Medicare or other funders and is payable by you. We appreciate as much notice as possible, as it allows us to offer your appointment time to another patient. 8. Consent to assessment and treatmentBefore treatment, your physiotherapist will explain the proposed assessment and treatment, including its purpose, what it involves and any material risks, and will answer your questions. Treatment proceeds only with your informed consent, which you may withdraw at any time. Where the patient is a child or a person who cannot provide consent, consent must be given by a parent, guardian or authorised decision-maker. 8.1 Access to your imaging and test resultsWith your consent, we may request reports of your prior imaging and tests — X-ray, CT, ultrasound, lung function and pathology — from the radiology or pathology provider who performed them, or from your GP or treating specialist. We request reports only, not your wider medical record, and only where they are relevant to your cardiorespiratory care. You may decline, or withdraw your consent at any time, and your care will not be affected. 8.2 AI-assisted clinical documentation (i-scribe)To support accurate record-keeping, we may use i-scribe (an AI ambient clinical-documentation tool provided by Akuru Pty Ltd) during your consultation. With your consent, i-scribe runs in the background, listens to your consultation and produces a text transcription, which your clinician then reviews and edits before any notes are added to your record. i-scribe assists with documentation only — it does not replace your clinician's judgement or decision-making. No audio recordings are stored. Text transcriptions are securely processed and stored in Australia, protected with encryption and restricted-access controls, and handled in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles and our Privacy Policy. We will seek your separate consent on a dedicated i-scribe consent form before using it. Using i-scribe is entirely optional — you may decline or withdraw your consent at any time, and your care will not be affected. 9. Your responsibilities, and raising a concernTo help us provide safe and effective care, you agree to provide accurate and complete information about your health, history and medications; to tell us about changes in your condition; to follow agreed treatment and home-program advice to the best of your ability; to treat our staff and other patients with courtesy; and to keep your contact and funding details up to date. 9.1 If you have a concernIf any part of your care, your treatment or your account is not what you expected, please tell us — we would rather hear about it. Our complaints process, the timeframes we work to, and the independent bodies you may go to instead of or after us — the Office of the Health Ombudsman in Queensland, and for the cohorts named in clause 5, the NDIS Quality and Safeguards Commission and the Aged Care Quality and Safety Commission — are set out on our Concerns and complaints page. Raising a concern will not affect the care you receive. Concerns about how we have handled your personal or health information follow a separate process, set out in section 16 of our Privacy Policy. Part B — Website terms of use 10. Use of our website and licenceThis website provides general information about Inspire Clinic and its services and facilitates appointment booking and patient registration. We grant you a non-exclusive, non-transferable, revocable licence to access and use the website for your own personal, non-commercial purposes in accordance with these Terms. You may print a single copy of any page for your personal reference. We may modify, suspend, or discontinue any part of the website at any time, and the website may be unavailable from time to time (including for maintenance). 11. Permitted use and prohibited conductYou agree to use the website only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use of the website by, any other person. You must not:
12. Health-information disclaimerThe content on this website is provided for general information only. It does not constitute medical advice, diagnosis or treatment, and it is not a substitute for professional clinical assessment by a qualified health practitioner. You should not rely on website content as a basis for decisions about your health. Our plain-language resource guides — including those describing symptoms, medicines, tests, techniques and when to seek care — are educational only; do not use them to self-diagnose, or to start, stop or change any treatment or medication without professional advice. Always seek the advice of your treating doctor or qualified health professional about any condition or treatment, and call 000 in an emergency. Any self-assessment or screening tool made available on our website (for example, a sleep-apnoea screening questionnaire) is indicative only. Its results do not constitute a clinical diagnosis and should be discussed with a health professional for proper assessment. 13. Intellectual propertyAll content on this website — including text, images, graphics, icons, video, the Inspire Clinic name and logo, and the website's design and layout — is owned by Inspire Clinic or its licensors and is protected by Australian and international intellectual-property laws. Except as expressly permitted in clause 10, or with our prior written consent, you must not reproduce, republish, upload, post, transmit, adapt, or distribute any content from this website. Nothing in these Terms transfers any intellectual-property rights to you. 14. Third-party links and online bookingThe website may contain links to third-party websites and services — for example, our online-booking provider (Nookal), an embedded Google Maps location, our social-media pages (such as Facebook), and health-directory or partner resources — and may embed third-party content such as maps. These are provided for convenience only. We do not control, endorse or accept responsibility for the content, products, services or privacy practices of any third-party website, and your use of them is at your own risk and subject to their own terms. Online bookings (Nookal). Online appointments are facilitated through Nookal, our third-party clinical practice-management and online-booking provider. Bookings made through the portal are subject to availability and to clause 3, and are not confirmed until accepted by our reception team. Nookal stores Australian clients' patient and booking data on Australian-based cloud servers, consistent with the Australian Privacy Principles and local health regulations, and advises that it also complies with HIPAA, the GDPR and other relevant data-protection standards. Your use of the portal is also subject to Nookal's own terms and privacy policy. Online forms (Resend). Our website registration, contact and screening forms are submitted to our own server (Cloudflare Workers) and delivered to the clinic by Resend, a third-party email-delivery service. Resend does not keep your submission as a stored record — it is delivered as an email and then held within our own clinic email and practice-management systems, subject to that provider's own terms and privacy policy. A second form-handling service (Web3Forms) was previously used as a standby delivery path. It was removed from our website in July 2026 and the account was closed in August 2026; it holds no information from us. How we collect, use and protect the information submitted through these services is described in our Privacy Policy. Spam protection (Cloudflare Turnstile). Our online forms are protected by Cloudflare Turnstile, a service provided by Cloudflare, Inc., which collects your IP address, device and browser information and interaction data to distinguish real people from automated abuse. In most cases it runs invisibly and asks you to do nothing. Cloudflare already operates the servers that host and deliver this website, so no additional organisation receives your information; it may process that information outside Australia and is subject to its own terms and privacy policy. Turnstile replaced hCaptcha (Intuition Machines, Inc.) on 31 August 2026, and hCaptcha no longer receives information from our forms. Website analytics (Google Analytics). We use Google Analytics 4 to measure and improve how the website is used. It sets cookies and collects de-identified usage information, which Google processes in accordance with its own terms and privacy policy. Google Analytics 4 does not log or store IP addresses. Full details, and how to opt out, are set out in our Privacy Policy. 15. Limitation of liability and consumer guaranteesNothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law, to the extent it cannot lawfully be excluded. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. To the maximum extent permitted by law, and subject to those non-excludable rights:
16. IndemnityTo the extent permitted by law, you agree to indemnify us, our directors, clinicians and staff against any loss, liability, cost or expense we reasonably incur arising from your breach of these Terms or your unlawful or negligent use of the website. This clause does not apply to the extent the loss is caused by our own negligence or breach. 17. PrivacyWe handle personal and health information in accordance with our Privacy Policy, which forms part of these Terms. Please read it to understand how we collect, use, store, disclose and protect your information. 18. Termination and suspensionWe may suspend or terminate your access to the website, or decline or discontinue services, where you breach these Terms, where required by law or for clinical or safety reasons, or where we cease to operate the website. Clauses that by their nature should survive termination — including those relating to intellectual property, liability, indemnity and governing law — continue to apply. 19. Governing lawThese Terms and Conditions and our Privacy Policy are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and any courts that may hear appeals from them. 20. General and changes to these TermsIf any provision of these Terms is invalid or unenforceable, it is to be read down or severed to the minimum extent necessary, without affecting the remaining provisions. Our failure to enforce a provision is not a waiver of it. You must not assign or transfer your rights under these Terms without our consent. We may update these Terms from time to time. The current version is always available at inspireclinic.au, and your continued use of our services or website after any update constitutes acceptance of the revised Terms.
